3. Procedure for Reporting
Copyright Infringement (Takedown Notice)
If you believe that
your copyrighted work has been copied and made accessible on the Bison website
in a way that constitutes copyright infringement, please provide a written
communication (an "Infringement Notice") that substantially includes
the following information:
Required
Elements for a Valid Notice
1.
A Physical or Electronic Signature of a person authorized
to act on behalf of the owner of the copyright or exclusive right that is
allegedly infringed.
2.
Identification of the Copyrighted Work claimed to have been
infringed, or, if multiple copyrighted works on a single site are covered by a
single notification, a representative list of such works.
3.
Identification of the Material that is claimed to be
infringing or to be the subject of infringing activity and that is to be
removed or access to which is to be disabled, and information reasonably sufficient to permit Bison to locate the
material (e.g., the exact URL/link on www.bisonproducts.in).
4.
Information Reasonably Sufficient to Permit Bison to Contact the Complaining
Party, such as your address, telephone number, and, if
available, an electronic mail address.
5.
A Statement that the complaining party has a good faith belief that use of the
material in the manner complained of is not authorized by the copyright owner,
its agent, or the law.
6.
A Statement that the information in the
notification is accurate, and under penalty of perjury (or equivalent
legal declaration), that the complaining party is authorized to act on behalf
of the owner of an exclusive right that is allegedly infringed.
7.
Undertaking (Required for Indian Law Complaints):
If you are relying on the Indian Copyright Act, a statement that you shall institute a suit in the competent court
against the person responsible for hosting the infringing content and produce the order of the competent court
within twenty-one days from the date of the receipt of the Infringement
Notice by Bison.
Upon receipt of a valid
and complete notice, Bison will act expeditiously to remove or disable access
to the allegedly infringing material.
4. Counter-Notice Procedure
If you are a user of
Bison and your material was removed or disabled as a result of a copyright
infringement notice, and you believe the material was removed or disabled by
mistake or misidentification, you may send a written counter-notice to the Designated
Agent listed in Section 2.
A valid Counter-Notice
must substantially include the following:
1.
Your Physical or Electronic Signature.
2.
Identification of the material that has been removed
or to which access has been disabled, and the location (URL) at which the
material appeared before it was removed or access was disabled.
3.
A Statement under penalty of perjury (or equivalent
legal declaration) that you have a good faith belief that the material was
removed or disabled as a result of mistake or misidentification of the material
to be removed or disabled.
4.
Your Name, Address, and Telephone Number, and a statement
that you consent to the jurisdiction of the Federal District Court for the
judicial district in which your address is located (or the appropriate court in
India, as applicable), and that you will accept service of process from the
person who provided the original Infringement Notice.
