These Terms and Conditions (“Agreement”) govern your use of the website www.bisonproducts.in (the “Website”), owned and operated by Bison (here in after referred to as “Bison”, “we”, “us”, or “our”).

By accessing, browsing, or using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to all the terms and conditions, you may not access the Website or use any of our services.

 

1. DEFINITIONS

1.1. “Customer/User”: Any individual or legal entity who places an order for goods or services on the Website.

1.2. “Products”: The goods or services offered for sale by Bison on the Website.

3. BASIS OF SALE AND ORDER PROCESSING

3.1. Product Representation: While we strive to provide accurate product information, including descriptions, prices, and images, the actual dimensions, colour, and appearance of the Products may vary. All sizes and measurements are approximate.

3.2. Order Confirmation: Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm such acceptance by sending you an email confirming the shipment of your Product (the “Shipment Confirmation”). A contract between us (“Contract”) will only be formed when we send you the Shipment Confirmation.

Product availability and pricing are subject to change without prior notice. If a Product is listed at an incorrect price, we reserve the right to refuse or cancel any orders placed for that Product.

 

4. PAYMENT, SHIPPING, AND DELIVERY

4.1. Payment: Payment for all Products must be by credit card, debit card, net banking, RazorPay gateway, UPI, or cash on delivery (where available) through the payment gateway or methods provided on the Website.

4.2. Shipping and Delivery: We will make every effort to deliver the Products within the estimated delivery time. However, any dates specified are estimates only, and we shall not be liable for any delay or failure to deliver the Products within the estimated timeframes.

4.3. Risk of Loss: The risk of loss and title for the Products pass to you upon our delivery to the carrier.

 

5. CANCELLATION, REFUND, AND RETURNS

5.1. Cancellation by Customer: You may cancel an order only before the Product has been dispatched. Once dispatched, the order falls under the Return Policy.

5.2. Refund Policy: Refunds will be processed according to our dedicated Refund and Return Policy, which is incorporated into this Agreement by reference. Please refer to that policy for detailed terms.

5.3. Defective/Damaged Products: If you receive a damaged or defective Product, you must notify us immediately (within 2 days of delivery) via email or phone with photographic evidence. We will arrange for a replacement or full refund as per our policy.

 

6. INTELLECTUAL PROPERTY RIGHTS

6.1. Ownership: All content, design, graphics, text, logos, button icons, images, audio clips, digital downloads, data compilations, and software on the Website is the exclusive property of Bison or its content suppliers and is protected by Indian and international copyright, trademark, and other intellectual property laws.

6.2. Limited License: We grant you a limited license to access and make personal use of this Website, but not to download (other than page caching) or modify it, or any portion of it, except with express written consent from Bison.

 

7. LIMITATION OF LIABILITY AND INDEMNITY

7.1. Limitation of Liability: To the fullest extent permitted by law, Bison shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Website; (b) any conduct or content of any third party on the Website; or (c) unauthorized access, use or alteration of your transmissions or content.

7.2. Indemnity: You agree to defend, indemnify, and hold harmless Bison, its owners, employees, and agents, from and against any claims, damages, costs, liabilities, and expenses (including, but not limited to, reasonable legal fees) arising out of or related to (a) your use of the Website, (b) your breach of any term of this Agreement, or (c) your violation of any law or the rights of a third party.

 

8. GOVERNING LAW AND JURISDICTION

8.1. Governing Law: This Agreement and any disputes or claims arising out of or in connection with it or its subject matter shall be governed by and construed in accordance with the laws of India.

8.2. Jurisdiction: You agree that the courts of TamilNadu shall have exclusive jurisdiction to resolve any disputes or claims arising out of or relating to this Agreement or your use of the Website.

 

9. USER GRIEVANCE AND COMMUNICATIONS (as per Consumer Protection Act, 2019)

10.1. Entire Agreement: This Agreement constitutes the entire agreement between you and Bison regarding your use of the Website.

10.2. Changes to Terms: We reserve the right, at our sole discretion, to modify or replace these Terms at any time. The “Last Updated” date at the top of this page indicates when the Terms were last revised. Your continued use of the Website after any such changes constitutes your acceptance of the new Terms and Conditions.
